This checklist is for couples preparing to register a nikah with ARAYA — Thai nationals, foreign nationals, or couples where one partner has newly embraced Islam — so you know exactly what documents to gather before choosing between a legally-effective nikah and a religious-only nikah. Two types of nikah certificate — choose the one that fits your situation
Type 1 — for destination countries WITH Shariah law — legally-recognized Nikah
- When the nikah concludes, you receive a certificate issued within Thailand’s legal framework
- After consular legalization it can serve as an international document — acceptance is always at the destination country’s discretion
- More documents and preparation time (~1 month)
- Bahrain, UAE, Maldives, Libya, Kuwait: embassy permission letter required
Best for: e.g. Bahrain, UAE, Maldives, Libya, Kuwait, Malaysia — or whenever you plan to use the documents in those countries
Type 2 — the option for couples from countries WITHOUT Shariah law — religious only (no legal effect)
- Fully compliant with Islamic principles (Shariah)
- Issued by the ARAYA Shariah Board — cannot be legalized at the Thai Consulate
- Popular in countries without Shariah law — there, even a nikah document correctly issued under Thai law carries no legal effect anyway
- Faster preparation, fewer restrictions — the guardian (wali) may join online
Best for: e.g. Thailand, Japan, and most countries without Islamic law — when you need the religious ceremony only

Preparing the wali (bride’s guardian) formally

The wali (bride’s guardian) is the person with the right and duty to give consent and protect the bride in the marriage ceremony. The order of who may serve as wali under Islamic principles is: the father or grandfather first, then a full or paternal brother, then a paternal uncle, and then a trustworthy religious scholar, in that order, if no one earlier in the order is available.
- The wali’s documents: a copy of the bride’s guardian’s ID card or passport (may be submitted online).
- The wali may join online — for the non-legally-effective path, the wali does not need to travel in person.
- If the bride has no suitable wali and no family attending — ARAYA can arrange a vetted wali hakim, only if the couple consents to the nikah being disclosed on the company’s public channels (e.g. Facebook or Instagram), so that public disclosure serves as the independent checker — per our Privacy & Transparency Policy.
- The wali supports — the bride confirms consent personally — per ARAYA policy, consent to marry must always be confirmed by the bride herself, in person. Family or a wali may support her, but they cannot substitute for her own consent.
If either party has been divorced or widowed before
If either party has previously been divorced or widowed, a certificate of divorce status, or the deceased spouse’s death certificate, is required in addition to the general documents above.
How much time to allow
- Allow at least a month to gather documents — some paperwork from your home country can take time to arrange
- The ceremony itself takes about 30 minutes, but set aside a full day for the process, and about one week in Thailand overall
- The ceremony generally takes place first, and official documents (such as a state-recognized Islamic authority certification for the legally-effective path) are usually finalized within a few days afterward — typically about 3-5 business days, though this depends on the authority involved and can vary case by case
Common mistakes and risk points
- No guarantee of foreign acceptance — whether a nikah certificate is accepted in your home or destination country is that country’s decision, and no provider can guarantee it. Always check your own country’s law first.
- A religious-only nikah is not a legal document — it is issued by the company’s own Shariah board, not a mosque or a government authority, and it cannot be legalised at a consulate.
- Some countries may not recognize certain forms of nikah — depending on that country’s own law and international agreements; recognition is not the same everywhere.
- Nationality-specific documents must match your current status — for example, embassy permission letters for citizens of Bahrain, the UAE, the Maldives, Libya, and Kuwait, or the additional requirements for Malaysian nationals. Confirm with ARAYA before travel, since embassy requirements can change.
- No secret nikah — whichever path you choose, every marriage is properly disclosed, protecting both parties’ marital status under Islamic principles.
